A REPEAT OF THE GRAHAM STAFFORD CASE?

WHO KILLED LEANNE?

The savage murder of 12 year old Leanne Holland in Goodna in September 1991 was one of the most brutal child killings in Australia’s criminal history. Sadly, very few people remember it. Leanne was battered to death, and possibly tortured and sexually assaulted.

There were no witnesses to the crime and police were unable to establish a motive. Flimsy and since discredited forensic evidence plus a hasty police investigation led to Graham Stafford — the boyfriend of Leanne’s older sister — being convicted of the murder.

Despite two appeals, two High Court challenges, and an appeal to the Queensland Governor, Stafford’s conviction has been upheld, and he remains incarcerated in prison. Yet, by being the first person to have gone as far as the High Court twice for the same criminal matter, Stafford created Australian legal history.

Now, ten years of painstaking research by former police officer and private investigator Graeme Crowley and criminologist Paul Wilson reveals that it is highly unlikely that Stafford could have committed the murder. Crowley and Wilson believe their investigation and analysis of this case raises enormous doubt and provides evidence that, properly put before the trial jury, would have presented no alternative to a verdict of ‘not guilty’. And, they go further by providing clues that could lead to the real killer.

Just as in Australia’s famous baby-dingo case in which Lindy Chamberlain was convicted of murdering her daughter Azaria, the police investigation into the murder of Leanne Holland shows the danger of obtaining convictions for murder based on inconclusive and questionable forensic science evidence. The case against Graham Stafford failed to establish motive and opportunity, and lacked alternative evidence to support the forensic findings.

By reinterviewing key witnesses including some investigating forensic experts, Crowley and Wilson demonstrate how a major miscarriage of justice in a murder case may occur. THE SO CALLED POLICE EVIDENCE

Justice Douglas heard Sica had also previously committed offences to destroy police evidence against him, and that he may do so again should he be released.

What a load of B.S. The so called police evidence was a SPEEDING TICKET which might i add was not even belonging to Max Sica. And it was from the 1990 case of the Ashgrove Police Station being burnt down. Max Sica like i stated in my blog was there, he did not light the match but yes he paid for his mistakes like all the others involved.

ANOTHER TIME WHERE DESTROY POLICE EVIDENCE IS USED
Det Sen-Sgt Joe Zitney alleged in an affidavit that the police case would be that Sica, Neelma's ex-boyfriend, killed all three and attempted to destroy crime scene evidence to conceal his identity. (why would he have to conceal his identity if he was in that house on many occassions?)

MAX SICA DENIED BAIL 27TH JANUARY

I was at the bail hearing once again, again no new evidence was brought forward. The judge could not state if the case was based on circumstantial evidence or not. All they stated was the same old B.S. about him being a flight risk and a threat.
His defence team was not at all what i expected and did not in my opinion do their job to the best of their abilities.

Part of the transcript taken from the recording in Mr Singh`s home about the confrontation between Max Sica and Mr Singh (recorded late in 2002) was completely misleading and not followed up with rest of the conversation.

I have heard the tape, THE WHOLE TAPE not just some sentence. Police was called to Mr Singh`s residence by both Max Sica and Mr Singh on the day of the confrontation. Police was also taped on that conversation and the proof is in the pudding of why Max Sica was there.

Mrs Singh repeatedly asked Max Sica if he was going to protect her, he said yes, no doubt.
Mrs Singh in late 2002 took an AVO out against her husband stating that she feared for her safety and the children`s safety.

The recording made in the Sica residence on the 20th September 2006 stated (by police) that Max Sica`s father had said to his son that if he was charged, he should flee.
Nowhere in the recording was the word FLEE ever mentioned. Not in english, not in italian.

As for police, if they were that sure about him leaving the juristiction so not to attend a so called secret cmc hearing, why didnt they go get him then and there? Why didnt they immediately go serve him with papers or arrest him? Why did they wait two years? Makes one wonder.

As for the judge, he clearly indicated that if you are about to be charged with a crime, whether you leave the juristiction or not will not be taken into account. So, excersise your leagal and moral right and run for your life.

Infact to prove this point when Dr Patel was removed from Qld health, he was given a business class ticket from Qld health to leave the juristiction and infact went overseas to the U.S.A . The state spent years and millions to bring him back only then to give him bail and pay all his living
expenses while awaiting trial.
Allegedly he caused numerous deaths by malpractise and manslaughter charges were brought against him. In his case, the scalpal, was in his hand.

Where is the justice? Better to run? Clearly gets better results.

When pending legal issues are lifted, the taped conversation regarding the confrontation between Max Sica and Mr Singh will be uploaded to this site for all to hear with their own ears.

Police allege tool used as weapon in Singh slayings

THE killer of three Brisbane siblings found dead in a spa bath in 2003 used a garden fork from their home to inflict head injuries, police will allege.

Documents filed in the Supreme Court in Brisbane for the bail application of Max Sica, the man accused of the Singh triple murders, outline the police case against him.

Autopsy results show that while Neelma Singh, 24, died from manual strangulation, she and her brother Kunal, 18, and sister Sidhi, 12, suffered head injuries, according to the documents.
The primary cause of death for Kunal was drowning and Sidhi died as a result of head injuries, on or about April 21, 2003, while their parents were in Fiji.

The police court brief and an investigating officer's statement allege:
• Bleach was used to clean parts of the crime scene.
• Sica emailed nude photos of Neelma to her family and friends in March 2003, after their relationship broke up.
• A few weeks before the deaths, Neelma and her father complained to police about concerns over Sica's behavior.
• In the month before her death, Sica told Neelma Singh he had a brain tumour.

Det Sen-Sgt Joe Zitney alleged in an affidavit that the police case would be that Sica, Neelma's ex-boyfriend, killed all three and attempted to destroy crime scene evidence to conceal his identity. (why would he have to conceal his identity if he was in that house on many occassions?)

Sica, who on December 30 was charged with the murders, claimed to have discovered the bodies in a spa bath when he went to the Singhs' house at Bridgeman Downs in Brisbane on April 22.
He has denied being at the house at the time of their deaths or being responsible for the murders.

The brief of evidence alleges that in the month leading up to the deaths, Sica created a fictitious story that he had a brain tumour to get sympathy from Neelma and entice her back into a relationship.

After her parents left for a trip to Fiji, Neelma wrote prayer documents offering support for Sica.
The police brief of evidence alleges that at 8.56pm on April 20 an SMS text was sent from Neelma's mobile to Sica, indicating she was expecting him to visit later that night.

The court documents indicated police will allege that after she let him in they had an argument and he manually strangled her, before using a garden fork from the garage to inflict further injuries.

Sica then allegedly used the garden fork to inflict injuries on Kunal and Sidhi, while they were in bed in separate bedrooms, the court brief says.

Police will claim he then used bed linen to drag the bodies of Neelma and Kunal into the master bedroom ensuite and put them in a spa bath, turning on at least one tap. Police allege he then carried Sidhi's body to the spa.

The police will allege Sica used household bleach found in the home to clean parts of the crime scene.

Police allege that on March 27, 2003, Neelma Singh recorded a conversation she had with Sica on her mobile phone "as she was concerned about his increasingly irrational and unpredictable behaviour".

She and her father, Vijay Singh, allegedly reported their concerns about Sica to Stafford police that day and Mr Singh later installed a sophisticated alarm system in the house.

In interviews with police, Sica allegedly claimed in the week leading to the deaths he went to the Singh home three times late at night and had sex with Neelma.

He allegedly told police that he parked his car away from the house and approached on foot, and Neelma let him in via a rear door.

Police allege the crime scene was staged to look like a failed burglary, but only Neelma's personal diary, a locket given to her by Sica and some earrings were missing. (search warrants issued for the Sica`s homes had quite a list of things police say was missing and were searching for)

On April 22, after Sica said he discovered the bodies, police claim they found a computer in his family home with a program designed to erase all data still running.

It is alleged another computer found in a Sica family holiday unit had a list of email addresses matching those who were sent nude photos of Neelma.

In an affidavit, Michael Byrne, QC, for Sica, said the Crown case was circumstantial and surprisingly weak.

He said there was ample evidence in Mr Singh's statement of others who had credible reason to harm the Singh family and who had made threats against the family.

Forensic psychologist Prof Ian Coyle's affidavit said he had examined Sica and found he did not pose a threat to potential witnesses and was not at risk of fleeing.

At the bail hearing on January 2, Mr Byrne said Sica had been charged with numerous offences over the years but had never skipped bail and had not left the country.

Mr Byrne asked for an adjournment so Justice Robert Douglas could hear a 2006 tape in which Sica's father allegedly encourages his son to leave the country if charged. On the tape, Sica allegedly says: "I don't do airports."

Mr Byrne said some psychological material presented by the DPP concerning Sica was "froth and bubble".

In his affidavit, Sica denied committing the murders and said he would adhere to all conditions if released on bail.

He described himself as a disability pensioner with back injuries.
He said if granted bail he would reside at his Toorbul home which he shares with his wife, their two-year-old daughter and his teenage son.

The bail application was adjourned until January 27.

Incest twist in Queensland triple murder case

Unsolved deaths ... the murdered Singh siblings came from a household of incest and violence, a court has heard.

IT is nearly six years since Neelma Singh, 24, her brother Kunal, 18, and sister Sidhi, 12, were allegedly murdered in their home in Brisbane's Bridgeman Downs.

Their mother Shirley Singh has kept their rooms as they were, turning her home into a shrine.
Her children's clothes are laid out on the beds of what her husband Vijay Singh, in his statement to police, called their "dream house".

But behind the tribute to her three children lies a darker tale with claims of domestic violence, incest and death threats - none of which involved the prime suspect, The Weekend Australian reports.

Following one of the most complex investigations in Queensland's history, police charged Max Sica 11 days ago with three counts of murder.

Mr Sica has repeatedly denied he had anything to do with their deaths.

At his bail hearing in the Queensland Supreme Court, last week, Mr Sica's barrister Michael Byrne QC said: "It has taken the police some six years to put together what is essentially a circumstantial case."

Questioned for 18 hours on one occasion and 14 hours on another, Mr Sica freely co-operated with police until his lawyers insisted they obtain warrants before further questioning.
Elements of the story emerged at Mr Sica's bail hearing.

Documents filed with the Supreme Court painted a disturbing picture of the Singh household in the years and months before the alleged murders.
Mr Singh tape-recorded conversations in the house, after he was threatened by people from Fiji, his homeland.

Police transcribed a recording made in 2003, before the murders, in which Ms Singh angrily accused her husband of indecent behaviour.
"You touched my daughter's pubic area," she said.
She also accused him of forcing her to have sex with a woman and many men - and possibly with Mr Sica.

In a statement to police in November, 2004, 18 months after the murders, that was also tendered to the court, Mr Singh said: "I have never approached Max Sica and encouraged him to have sex with my wife Shirley."

The tape recorded conversation between the Singhs revealed that Mr Sica entered the room and became embroiled in a furious argument with Mr Singh.
"I know what you did to your daughter," Mr Sica said. "I know what you did to us. I can cave your f--king head in right now and get away with it, capisce?"

Mr Singh kept telling Mr Sica to get out of the house.
"I give you the right to stay here to protect me," Ms Singh told Mr Sica.

In documents tendered by the police, Detective Senior Sergeant Joseph Zitny, the investigating officer, stated that Mr Sica had a "propensity for violence" and should not be given bail. Sergeant Zitny quoted the threats Mr Sica allegedly made during the argument with Mr Singh.

The defence team contended that the threat was taken out of context and was misleading. "The context of the threat relied on by Sergeant Zitny is a conversation in which Shirley Singh is saying that Vijay Singh will be charged because of his sexual maltreatment of the deceased child Sidhi."

The transcript revealed that Mr Sica repeatedly told Mr Singh: "Put the weapon away."
During the bail hearing, Ian Coyle, a forensic psychologist who had assessed Mr Sica for the defence, said the weapon Mr Singh had picked up was "a knife of one sort or another".

In the statement he gave to police in 2004, Mr Singh said that seven years earlier, in 1997, he had pleaded guilty to assault in the Queensland District Court after beating Neelma, then 18, with a broken pool cue.

In 2002, his wife took out a restraining order against him.

Mr Singh is often in Suva, where he has a motor spare parts business. He and his wife were there when their children were murdered.

In his statement to police, Mr Singh said he had started recording conversations in his home after receiving threatening calls, conceivably from relatives of a woman in Fiji with whom he had recently had an affair, a nightclub manager in Suva he had given his home number in Brisbane.

"They used words like 'kill your wife and rape your daughter'," he told police.

The defence team's bail application said the material tendered by the Crown provided "ample evidence of other persons who have credible reasons to harm the Singh family".

But from the first, police were focused on Mr Sica as the main suspect.

This morning i could not believe it when i was surfing the net and newspapers and found an article in THE AUSTRALIAN newspaper actually stating some TRUE FACTS (not allegations but a factual taped conversation).

I do not know what has happened for the media to at least start considering that there are other sides to this story and that they needed to be heard.

Whatever it is, i am glad that the media (or some of it at least) had the courage to show some impartiality. I am still bewildered but pleased.

CONTINUED POST

As for the family of Mr Max Sica, they have gone through as much grief as anyone. The singh children were like part of their family, Mrs Singh was very close to the Sica family too. They (the sica family) were in the same shock, disbelief and grief as anyone else when they heard what had happened to Neelma, Kunal and Sidhi. In their grief they had to also deal with their son being considered a suspect, their home being searched by police on numerous occassions (including the homes of Max`s sisters), the children of the Sica family(aged 5 to 11) who were with Max Sica (on the day of discovering the bodies) being questioned over and over again, media who accumulated like vultures nearly everyday on their doorstep, phone calls continuously from media to their home etc etc . Some people decided to drive past their home and scream out murderer or some other comment, their cars parked outside their residence pelted with eggs. It was like hell on earth.

On the day of the funeral, Max Sica was escorted out by police on request of the singh`s. The police knew he was going to be there, no one called to say dont come you are not welcome, the police didnt advise any of the Sica family members that Max Sica was not wanted there.

Max Sica went there to pay his respects for the singh children, he was devastated. I was at the funeral and saw 4 or 5 officers in suits rushing over to a spot, i wondered what is happening, someone must be in danger or causing danger. To my surprise they were surrounding Mr Max Sica and escorted him out and not through an exit where there was no media, they escorted him out right in front of all the media cameras. The rest of the Sica family stayed just to hear the end of the mass for the children and then left. They didnt cause an uproar because they were there for one purpose only FOR THE SINGH CHILDREN. Just imagine what it was like for them, they could have walked out, but they chose to stay till the end of the mass and pay their respects only for those children. to be continued........

JUST A FEW TRUE FACTS


On the day max sica discovered the bodies, he was with his son , his daughter and his niece. (aged from 5 to 11 yrs of age) He had passed by with the kids to see if they (the singh children) wanted to go to the movies. He had tried to call the house and on mobile but kept on getting no answer. When he arrived, he noticed that the cars were in the garage and a side door leading into garage was unlocked. He thought this odd as no one inside answered the phones. Upon opening the door, the singh`s childrens dog leaped at him and shook. He then proceeded to enter the home, and in doing so, discovered the horrendous scene. He must have been in utter shock.

On that same day, police took him in for questioning (18 hours of it) He was examined to see if he had any markings on him (defence wounds from victims etc) none were found. He did not think of going in with a lawyer because he had nothing to hide and did not consider himself to be a suspect in any way.

The police were saying to media at beginning that he was a witness BUT they would say this only when faced with media. The truth is that they had already targeted him and considered him a suspect from beginning. The day Max Sica was taken through the singh home (his father present with him) all the police kept on saying to him was come on, tell us who you killed first, we know you did it etc etc. Max sica was seen on news coming out of there nearly collapsing. I can just imagine what it would be like to have witnessed a scene like he did, then have to return to it while police at same time are accusing you of it.

Max Sica was called on quite a few occasions to go to the singh residence by the mother Mrs Singh or one of the singh children for support in certain matters.

Max sica was brought up on newspaper articles even for a traffic violation. When he was brought up for driving without registration and insurance, well to begin with, the car belonged to a family member, who forgot to update both things. It has happened to me personally and im sure if it had happened to me to be pulled over by police and not realizing it be fined, im sure i would`nt be on the news over it.

I was at the bail hearing on friday 2 january. All i can say is that the public does not know the full extent of what was actually said on that recording between Mr singh and Max Sica. The only thing i clearly understood is that Max Sica was there on the request of Mr Singh`s wife.

On that recording Mrs Singh was making accusations against her husband (in very graphic details) about what he had done to her, and her children. (including bashings of her children and sexual molestation) Max sica was in no way there to threaten the parents of the singh children.


As for the judge repremanding Max`s lawyer about not making certain comments to media about trumpt up charges, trial by media etc etc Well what about all the media coverage on Max Sica? Did anyone in authority try to stop the media when they hounded him and his family? Did police ever step up and at least write some wrongs that had been stated? Max Sica is having basically a Trial by Media. No new evidence was put forward at the hearing, Mr Carlo Sica never told his son to flee the country, and has always cooperated with police in every way shape and form as his son Max Sica has done.

This case has been going on for nearly six years. Max Sica has been under scrutiny from police since the beginning. Is this a case of tunnel vision? Is the police under so much pressure to solve this case that putting away an innocent man is the answer? I ask where is the justice? Too much justice can sometimes be a great injustice.

Is this what the police say they have for charging Max Sica with the triple murders? They charged him because they consider him a FLIGHT RISK? And of top of that they allege it was a taped conversation in 2006? In 2006 this man could have gone wherever he wanted to go, he was a FREE MAN. His was not on parole, he was not charged with anything, so i dont see the significance to begin with.

I am also sure that they only presented part of a conversation on that taping. I am sure when the whole converstion is heard, it wont sound like they wanted to portray it at all.

From the beginning this man has given police everything, dna, clothing, cars, footprints, earprints, his whole body was examined and photographed to see if he had any kind of markings on it (scratches, bruises defence wounds from victims) he did`nt even have a scratch.

At the beginning, i remember that they didnt even acknowlegde that he was neelma`s boyfriend, it was stated that he was infatuated with her, stalking her etc etc. Now i see the papers are regarding him as the ex-boyfriend.

Max Sica had always protected those kids, and their mother from the violence of their father, MR SINGH. I dont see police investigating and scrutinizing him. It also seems to me that the media is suffering from partial deafness and blindness, since they do not report what they truly hear, see and read.

This is one of the greatest injustices ever. Seems more like a circus to me than anything else. If this would`nt be so serious and devastating, it would be commical.

Shortly after Max discovered the bodies, he went to chermside shopping centre. While there he passed by a shop where Kunal`s girlfriend worked. He waved to her and she incredulously stated that the wave was a threat to her and security was called.

Police also arrived and unbenounced there was the media too. The media was there in a flash, ready to hound him just that bit more and slowly but surely start a character assassination campain. (in my opinion, hand in hand with police)

This man has had and has constant surveilence on him since discovering the bodies. If he passed gas (fart) they knew about it. What kind of life is this?

As for the flight risk aspect, well if i was hounded to that extent day in day out, if my family was put under a microscope along with me, if i had to walk around with a big question mark over my head and people whispering things when i walked past, i think i would have had about enough and even welcomed a trial to prove my INNOCENCE and CLEAR MY NAME.

As you can all see this man has never moved from where he was. He has never fled even if he could have done so when he was a completely free man and was in his right to go even to the ends of the earth. This man has a family, he has 3 children and a wife. He has always stated his innoncene from the very first day.

Now for the arsonist issue...... In 1990 when max sica and about another 5 or 6 guys were charged, they were all charged for the same thing, its only that max sica got the longest sentence, makes me wonder why. Yes a police station was burnt down, dont know who lit the match, but i agree that if youre with the people that do it, youre just as guilty and i also agree that he Max Sica, had to be punished along with the others. Not only was he punished, but he spent the most time in jail.
His lawyer at that time told him to accept a plea bargain, Max Sica wanted to plead guilty to the things he had done and not to other charges that he didnt even know existed or participated in. His lawyer also convinced his parents that it was the only option to take even though he knew his client was right. He said just take the plea bargain thats just how the system works, if you dont take the plea bargain, it will be against your best interests. Well in the end his parents (who believed in what their sons lawyer was telling them) and his lawyer convinced him that it was the only way to go. As soon as he took the plea bargain and pleaded guilty the judge gave him the longest sentence. The others didnt even get half that.
This man has paid well and truly for crimes he commited many years ago. May i add that in that what they call CRIME SPREE, he didnt go kill anyone, or cause bodily harm to anyone.
Yes this man does have a criminal past, but does not mean that it automatically makes him a TRIPLE MURDERER. to be continued.........
